These Terms of Service ("Terms") govern your access to and use of the CalWorkLaw website, application, and related services (collectively, the "Service"). The Service is operated by X-szállás Kft., a Hungarian limited liability company with its registered seat at 1088 Budapest, József krt. 2., Hungary ("we", "us", "our" or the "Company"). By accessing or using the Service you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
CalWorkLaw provides an AI-powered information assistant focused on California labor and employment law. The Service generates responses based on publicly available statutes, regulations, and case law. The Service is an informational and educational tool only and is not a substitute for advice from a licensed attorney. See our Disclaimer for details.
2. Eligibility & account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- infringe any intellectual property, privacy, or other rights of third parties;
- upload malware, attempt to probe, scan, or breach the security of the Service;
- scrape, harvest, or systematically extract data from the Service;
- resell, sublicense, or redistribute the Service or its outputs as a competing product;
- use the Service to generate content that is illegal, defamatory, harassing, hateful, or otherwise objectionable;
- reverse engineer, decompile, or attempt to derive the underlying models, prompts, or source code;
- circumvent any usage limits, rate limits, or technical restrictions.
4. AI outputs & accuracy
Outputs generated by the Service may be inaccurate, incomplete, or out of date. AI models can "hallucinate" — meaning they can produce confident but incorrect statements, citations, or quotations. You are solely responsible for verifying any information before acting on it, and for ensuring you have the legal right to any inputs you submit. You retain ownership of your inputs; subject to applicable law, ownership of outputs is assigned to you, except that the Company retains all rights in the underlying Service, models, prompts, and infrastructure.
5. Not legal advice
Use of the Service does not create an attorney-client relationship. The Company is not a law firm and does not practice law. For advice on a specific situation, consult a licensed California attorney. See our Disclaimer.
6. Subscriptions, payments & Paddle
Paid plans are billed in advance on a monthly or annual basis as selected at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. You can cancel your subscription at any time; access continues through the end of the billing period for which you have paid. See our Refund Policy.
7. Intellectual property
The Service, including all software, documentation, design, trademarks, and branding, is owned by the Company or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal personal or business use within your selected plan. No other rights are granted.
8. Service availability
We strive to keep the Service available but do not guarantee uninterrupted, timely, secure, or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.
9. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable period.
10. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF CONTENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) USD 50. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, DEATH, OR PERSONAL INJURY WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
12. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising out of your inputs, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
13. Governing law & disputes
These Terms are governed by the laws of Hungary, without regard to conflict-of-law principles. The courts of Budapest, Hungary shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection laws of your country of residence.
14. Changes
We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after the effective date constitutes acceptance.
